While I’m waiting until after Luke Wenke’s next court hearing (April 10th) to publicly post most of my recently obtained records, I’ve decided to share this booking paperwork. I obtained these documents from the Orleans County government through a Freedom of Information request along with correspondence records, which are currently available through this website’s private Facebook group.
I’m currently awaiting additional public records from several agencies and am in the process of requesting more. I’m doing this because I strongly believe it’s in the public’s best interest to have access to the information contained within Luke Wenke’s records, especially given the uncertainty surrounding the future of his case.
What I Know
I can’t predict what will happen with the case and I’ve stopped thinking about it in terms of when it’ll finally be over. It’s starting to seem like the case will never end, and I realised I was starting to drive myself crazy hoping for a resolution.
I always strive to show respect to the authorities, but I’m extremely nervous about the mental health aspect of the case. Given my lack of legal knowledge, I don’t know how the competency/commitment process works, especially in a situation where a defendant has already been convicted and deemed competent. The court is currently in the process of deciding whether to require Wenke to undergo inpatient treatment and what type of facility, if any, is most appropriate for his situation.
I could be wrong about this, but based on my research, if the judge mandates Wenke to treatment, the court will periodically revisit his progress to determine whether his condition has improved enough for the case to proceed to the sentencing phase.
One question the authorities have repeatedly failed to answer is whether there’s a possibility of Wenke being declared “unrestorable” and, if so, what his involvement with the legal system would look like moving forward if that were to happen. I don’t want to speculate due to my lack of knowledge on the matter, but I’m scared that this could somehow lead to his eventual release from treatment without legal supervision.
Please do not assume that this is a possibility or a likelihood. I don’t know if it is. I tried to gain clarity on the matter several times since this process began over a year ago, but my questions were never answered. In the meantime, I’m gathering as much information as I can for the sake of making the most educated and informed safety-related decisions possible. I know I’m not the only person who’s concerned for their safety and sharing these records is the right thing to do.
